AGREEMENT
BETWEEN
THE REPUBLIC OF SUDAN
AND
THE FEDERAL DEMOCRATIC REPUBLIC
OF ETHIOPIA
ON GOODS IN TRANSIT
JULY2001
The Republic of the Sudan and the Federal
Democratic Republic of Ethiopia herein after referred to as the
contracting parties,
Pursuant to the agreement signed at the 4th of
August, 2000, the Ethiopian-Sudanese Customs administration
meeting at Addis Ababa.
Aware of the mutual benefit in creating
favorable condition for the movement of Goods in Transit
originating form & destined to Ethiopia,
Recognizing the need to simplify, harmonize &
streamline customs transit procedure of the contracting parties to
facilitate the movement of
Goods in transit,
Aware of the advantage of having Customs
Transit Agreement for expediting Customs transit Procedure,
Hereby agree as follows.
ARTICLE 1
DEFINITIONS
For the purpose of this agreement:
"Customs" means the Customs Administration/
Authority in both the contracting parties to this agreement.
"Chief Customs Officer "means any officer for
the time being in charge of a customs station.
"Customs enclosure" means any place at a
customs station, port or aerodrome designated by the respective
authorities where goods are stored under customs control until all
customs procedures are completed
"Customs Port" administration includes any port
designated by the respective customs
"Customs Transit" means the procedure under
which goods originating fr°1!l and destined to Ethiopia are
transported under customs control.
"Cargo in Transit" mean any transit cargo
originating from and destined to Ethiopia.
"Cargo Declaration" means information submitted
prior to or on arrival or departure of means of transport for
commercial or personal use that provides the particulars required
by the customs relating to goods brought or cleared from customs
territory.
"Customs Territory” means the territory or
boundary in which the respective laws of each party apply in
full.
"Customs Transit Operation" means the transport
of goods from and destined to Ethiopia under Customs transit
procedure.
"Carrier" mean any person who undertakes to
perform or to procure the performance of transport for cargo in
transit originating for and destined to Ethiopia by rail, road, or
air or by a combination of such modes.
"Customs Defined Route" means any road defined
by the two contracting parties for the movement of goods in
transit.
